1. Acceptance of Terms

By downloading, installing, or using the SWEL Health application (“App”) or accessing our website at swelhealth.com (“Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.

These Terms apply to all users of the App and Site, including users who access SWEL Health through connected wearable ecosystems such as Huawei Health, Garmin, COROS, Samsung, Polar, or Suunto.

2. About SWEL Health

SWEL Health is a physiological intelligence platform developed and operated by Immersive Authority (Pty) Ltd, a South African technology company. Our platform ingests biometric data from multiple wearable devices and health ecosystems and transforms it into clinically informed, AI-assisted insights.

SWEL Health is not a medical device. We are an information analytics platform.

Our analytical engines — including the Physiological Cost Index (PCI), Vital Drift™, and Environmental Normalization Module — are designed for educational and performance optimization purposes only and do not constitute medical advice, diagnosis, or treatment.

3. Eligibility

You must be at least 18 years of age to use SWEL Health. By agreeing to these Terms, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into this agreement. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Provide accurate and complete information when creating an account
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account
  • Not share your account with any other person

Account authentication is managed by Firebase Authentication (Google LLC). We do not store your password. Password resets are handled securely via email verification.

5. Third-Party Wearable Integrations

SWEL Health integrates with third-party wearable platforms to access biometric and activity data. By connecting a third-party account, you acknowledge and agree to the following:

5.1 Huawei Health Kit

SWEL Health integrates with Huawei Health Kit to access biometric and activity data from Huawei wearable devices (including Huawei Watch, Honor Watch, and Huawei Band series) and the Huawei Health application.

  • We access only the specific data categories you explicitly authorize during the connection process.
  • Data accessed may include: heart rate, steps, distance, calories, sleep stages, blood oxygen (SpO₂), body temperature, stress score (HRV-derived), active minutes, workout activity records, GPS routes, and body composition data from Huawei-compatible smart scales.
  • This data is used exclusively to calculate physiological recovery metrics, training load analysis, sleep quality scoring, environmental normalization, and personalized AI-assisted coaching insights.
  • We do not sell, share, or transfer your Huawei Health data to third parties for advertising, insurance, or commercial profiling purposes.
  • All data is encrypted at rest (AES-256 via SQLCipher) and in transit (TLS 1.3).
  • Historical data (up to one year) may be accessed to establish accurate physiological baselines for our analytical engines (Vital Drift™ baseline requires 30–90 days; Chronic Training Load requires a 28-day rolling average).
  • You may revoke Huawei Health access at any time via Settings → Connected Services within the SWEL Health App, or directly through the Huawei Health application.

Your use of Huawei Health Kit data within SWEL Health is also subject to Huawei’s Terms of Service and Huawei’s Privacy Policy.

5.2 COROS

SWEL Health integrates with the COROS Open Platform API to access activity and biometric data from COROS GPS sports watches (including the COROS PACE, APEX, VERTIX, and DURA series).

  • We access only data categories you authorize during the OAuth consent process on your COROS account.
  • Data accessed may include: workout activity records, GPS routes, heart rate data, training load metrics, lap data, and HRV status where available.
  • This data is used to power SWEL’s Training Load Engine, Race Time Prediction Engine, Route Analysis, and AI Coaching context.
  • COROS does not natively provide a proprietary stress score; SWEL derives a stress proxy from HRV (RMSSD) and resting heart rate when this data is available.
  • We do not sell or share your COROS data with third parties.
  • You may revoke COROS access at any time via Settings → Connected Services within the SWEL Health App, or through your COROS account settings at training.coros.com.

Your use of COROS data within SWEL Health is subject to COROS’s Terms of Service and COROS’s Privacy Policy.

5.3 Garmin Connect

SWEL Health integrates with Garmin Health API to access activity and biometric data from Garmin GPS devices.

  • Data accessed may include: activity records, heart rate, Body Battery, stress score (Firstbeat-based), sleep data, and GPS routes.
  • Garmin integration is performed via OAuth-based authorization through the Garmin Health API.
  • You may disconnect Garmin at any time via Settings → Connected Services or through your Garmin Connect account at connect.garmin.com.

Your use of Garmin data within SWEL Health is subject to Garmin’s Terms of Service and Privacy Policy.

5.4 Other Wearable Providers

SWEL Health may additionally ingest data via Android Health Connect, supporting providers including Samsung Health, Google Fit, Polar, Suunto, and others that contribute data to the Health Connect data store. When you grant SWEL Health access to Health Connect, you authorize us to read the specific health data categories you select. You may manage Health Connect permissions at any time via Android Settings → Health Connect.

5.5 Data Minimization Principle

For all integrations, SWEL Health adheres to a strict data minimization principle: we request only the data categories that are actively displayed or analytically processed within the App. We do not request access to data we cannot visually or analytically justify.

6. AI-Powered Features and Multi-LLM Architecture

SWEL Health uses artificial intelligence to generate coaching insights, training recommendations, recovery scores, and health briefings. Our AI architecture uses multiple large language model (LLM) providers:

  • Google Gemini (Gemini 2.5 Flash, Gemini 2.0 Flash) — used for multimodal vision and OCR tasks (workout screenshot analysis, medical document parsing) and AI coaching text generation
  • DeepSeek (V3 / R1 Reasoner) — used for text-based coaching and clinical reasoning tasks when configured
  • Google ML Kit — used for on-device OCR as a first-pass analysis step (no data leaves your device)

Important safeguards regarding AI and health data:

  • No raw biometric data from any wearable integration is transmitted to any LLM provider without anonymization and context stripping.
  • AI-generated insights are not medical advice. They are informational outputs based on your physiological data patterns and peer-reviewed physiological models.
  • All AI coaching outputs include appropriate clinical disclaimers.
  • You should always consult a qualified healthcare professional before making changes to your training, nutrition, or health management based on any SWEL insight.

By using AI-powered features, you acknowledge that these features use third-party AI services and that outputs may occasionally be inaccurate or incomplete.

7. Subscription and Freemium Model

SWEL Health operates on a freemium model. Certain advanced features — including extended historical analysis, AI coaching context depth, and premium analytical engines — may require a paid subscription.

  • Subscription plans, pricing, and features are displayed within the App.
  • Payments are processed by Google Play Billing. SWEL Health does not store payment card information.
  • Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
  • Cancellations take effect at the end of the current billing period.
  • Refunds are governed by Google Play’s refund policy.

8. Coach Connection Feature

SWEL Health includes a Coach Connection feature that allows you to share your health data with a coach or healthcare professional of your choosing.

  • You initiate sharing by generating an 8-character secure link token and sharing it with your coach.
  • Data shared with a coach includes: recovery score, HRV trends, sleep summaries, workout history, training load, and heart rate data.
  • No personally identifiable information (PII), medical documents, or location data is shared through Coach Connection unless you explicitly authorize additional data categories.
  • Tokens are valid for 90 days and can be revoked instantly via Settings → Coach Connection.
  • You are responsible for ensuring that the coach or individual you share your link with is a trusted party.

9. Prohibited Uses

You agree not to:

  • Use SWEL Health for any unlawful purpose or in violation of any local, national, or international law
  • Attempt to reverse-engineer, decompile, or extract the source code of the App
  • Interfere with or disrupt the security or integrity of our systems
  • Upload, transmit, or share false, misleading, or fraudulent health data
  • Use the App to make clinical decisions without the guidance of a qualified healthcare professional
  • Attempt to access another user’s account or health data
  • Use automated tools to scrape, harvest, or extract data from the App or Site

10. Intellectual Property

All content, trademarks, analytical engines, algorithms, software, and materials on the SWEL Health platform, including the Physiological Cost Index (PCI), Vital Drift™ engine, Arrhythmia Guard, Environmental Normalization Module, and DFA Alpha-1 threshold detection implementation — are the intellectual property of Immersive Authority (Pty) Ltd and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

11. Medical Disclaimer

SWEL Health is an information analytics platform, not a regulated medical device.

The insights, alerts, scores, and recommendations generated by SWEL Health, including Vital Drift™ alerts, Physiological Cost Index scores, Arrhythmia Guard notifications, SpO₂ desaturation flags, and AI coaching briefings — are provided for educational and performance optimization purposes only.

  • They do not constitute medical advice, diagnosis, or treatment.
  • They have not been evaluated by the South African Health Products Regulatory Authority (SAHPRA), the U.S. Food and Drug Administration (FDA), or any equivalent regulatory body.
  • Always seek the advice of your physician or a qualified health provider with any questions about a medical condition.
  • Never disregard professional medical advice or delay seeking it because of an insight from SWEL Health.
  • In a medical emergency, contact your local emergency services immediately.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Immersive Authority (Pty) Ltd, its directors, employees, and partners shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or Site
  • Any health or medical decisions made based on SWEL Health insights or AI-generated coaching
  • Any loss of data arising from account deletion, device failure, or service disruption
  • Any unauthorized access to your health data resulting from your own disclosure of account credentials

Our maximum aggregate liability for any claim under these Terms shall not exceed the amount you paid for SWEL Health subscriptions in the 12 months preceding the claim.

13. Data Deletion and Account Termination

You may delete your account at any time via Settings → Privacy → Delete Account. Upon deletion:

  • Your personal profile (name, email) is permanently removed from Firebase Authentication and Firebase Firestore.
  • All health observations stored in our encrypted database are cryptographically purged. We do not “soft delete” or archive your data.
  • Your Coach Connection tokens are invalidated.
  • Any connected wearable integrations (Huawei, COROS, Garmin) are disconnected; you should also revoke access from the respective third-party platforms.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via the App or by email. Your continued use of SWEL Health after changes take effect constitutes your acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

For users in the European Economic Area (EEA): To the extent EU consumer protection laws apply, nothing in these Terms limits your statutory rights under applicable EU law.
